[h=3]Who is eligible for an APP?[/h] To qualify for an APP, the individual must be certified by an APP program recognized health practitioner as having one or more of the following conditions:

  • Cannot walk without assistance of another person or a brace, cane, crutch, a lower limb prosthetic device or similar assistive device or who requires the assistance of a wheelchair.
  • Suffers from lung disease to such an extent that forced expiratory volume in one second is less than one litre.
  • Portable oxygen is a medical necessity.
  • Cardiovascular disease impairment classified as Class III or Class IV to standards accepted by the American Heart Association or Class III or IV according to the Canadian Cardiovascular Standard.
  • Severely limited in the ability to walk due to an arthritic, neurological, musculoskeletal or orthopaedic condition.
  • Visual acuity is 20/200 or poorer in the better eye with or without corrective lenses or whose greatest diameter of the field of vision in both eyes is 20 degrees or less.
  • Condition(s) or functional impairment that severely limits his or her mobility

Don't burn the rider unless you definitively ascertain whether he or she is entitled to use it. Leave a note for the rider explaining the concern and maybe your e-mail address or phone number for them to respond. Wouldn't you feel like a real ******* if you caused the bike to get towed only to find out the guy or girl had a legit reason to use the space?

Anyone who has a legit medical condition which warrants them to use that space cannot be reasonably expected to display a handicap permit for the same reasons why the 407 ETR doesn't make riders mount a transponder on the bike.

If you're unwilling to do a bit of digging to find out whether they're entitled to use that space then it can't be bothering you that much and therefore the rider should be left alone.

On a side note, its my understanding that the marking paint on the asphalt has not legal significance. If there isn't a corresponding handicap sign (one for each reserved space) with the applicable by-law on it; then it would get thrown out in court. Or so I've been told, I'm not an expert on municipal by-laws. From the picture provided it doesn't appear that space has it's own handicap sign unlike the ones next to it.
 
That may be the legality, but I think we're talking about the right thing to do. There's a vid of a guy with one arm and one leg ripping it on the track. Gets on the bike from a wheelchair.
