Injury after the fact of car accident.

So last October my Wife was rear ended on the highway, when the accident happened she saw the car closing in fast and turned around to look as the car hit her.
Said her back hurt, but sucked it up as she thought it was just minor whiplash and would go away, so didn't bother filling out any injury reports.
Last month or 2 she has been complaining about a sore back and went to the doctors who confirmed she has a crushed disc and 2 herniated discs in her back and told her to take off work through disability and go on EI (Much less income) until she can have her back surgery (Which could take a very long time).

Is there a limitation on time to claim an injury from insurance?
If insurance did cover this, What would they might cover? Top up pay, physio, rehab?

Any info is useful before I call and ask them directly, Just want my research done first.

Best to ask the agent that handled the claim. She may have signed off that the claim was complete, no injuries, and that you couldn't sue in the future.

They cover 80% of her wages up to a maximum of $400/week and 100% of the cost of physio, equipment, gym membership, etc.

I think you have up to a year to claim. Maybe try sending a PM to Platinum_Cycle (a claims adjuster) if you want a definitive answer. I hope your wife gets better!
 
Everyone should condition themselves to babble about how they feel after a collision. Too many people don't want to make a fuss and regret it later.

I told her to fill out the paperwork after the crash to be on the safe side in case anything comes of it, but as usual she didn't listen lol

Statute of limitations in Ontario is 1 year for physical damage and 2 years for personal injury.
 
And as much as I hate the American sue first approach..I would lawyer up right now to make sure your rights are protected even if you never intend to sue in the future. The first consultation should be free so worth the couple of hours of your time to get the necessary information to make an informed decision.

She is just getting all the questions ready to be asked and then she is going to have a consultation.
Just want to make sure we have all our questions in before we speak to them as it always seems you forget to ask certain questions when you rush it to get it in.
