Impound Storage Fees Laws

Hello,

So my bike was impounded last week for 7 days and now when I called to pick it up. They are saying $350 for towing and $350/day for storage+ admin fee so total of about $1800. Can someone let me know if there are any rules to the maximum fee or should I just take them directly to small claims court. A little guidance would be appreciated. Thank you!
 
As I understand it, you're screwed. This is generally the real cost of HTA 172 - even though most people don't get convicted, they're on the hook for the impound fees. You are not going to get any traction with getting the fees reduced. However, if there was any damage done to your bike, you may be able to seek compensation for *that*.
 
Your math I a little off, It would be actually $2,800 they are charging you.
 
That's crazy, no way it's that much.

should be <$1000 for 1 week and towing charges. how much less depends on your negotiating skills.
 
I remember reading somewhere that you can go to the city clerk (or something like that) and "pay" them. They will hold the money while you dispute the charges. That way you can then go get your bike and take the company to court.


I try to explain how this is why this law should be AGAINST the law. This person posed no threat to public safety like a drunk would, but he had his vehicle impounded. He will now go to court, probably plead to a lesser charge, therefore never be found guilty of HTA172. But he will never see this money again.

Tried, convicted and punished all before he steps before a judge. How is that fair!
 
I remember reading somewhere that you can go to the city clerk (or something like that) and "pay" them. They will hold the money while you dispute the charges. That way you can then go get your bike and take the company to court.

i believe this city clerk process was for disputing the actual storage fees imposed by the impound yard. not to argue the constitutionality of 172

Yes, I meant the impound charges, not the criminal charges, lol.
 
I just called the tow company and told them I most my job because I lost my liscennce and have no money and rent to pay. Got it knocked down to 800
 
350/night is a huge over charge. When my GSX-R 600 was stolen and recovered I had to pay 60/night to the impound yard that held it.
 
This is one of the many things that has fallen through the cracks, as a result of HTA 172. There was a bill in The Legislative Assembly that was intended to cover things like towing charges, but to my knowledge it has never been passed.
 
It's interesting that for street racing/>150 tows and impound, it all goes to one company, and the owner of that company drives three exotic Italian sports cars. Some of these impound charges exceed a night's stay at a nice hotel.
And Quebec has corruption problems...

Thats right ...get the scum bag tow company to give you a break down in writing...tell them the person lending you the cash wants to see it, then take that to the local to tow company small claims court and tell them you woul like to make payment....put down some $$ then they stamp it that you have started to make payment..then take that to the tow company and say please release my bike...if they don't you can call police and let them come down to tell them to release your bike. I had a grease ball tow company charge me $1300 cash for my stunt driving back in 2008 in Bolton..
