HTA 172 Excessive Speed Charge - Looking for Advice

Hi everyone,

Last week I was clocked doing 105 km/h in a 50 zone. I was charged with stunt driving and speeding (2 tickets). Also had my license suspended for the week and my bike was impounded.

My summons to court is in a few weeks. I'm still unsure as to how I should handle this. If they offer me a plea bargain with a 49 over charge should I take it? Or should I go the paralegal route with Redline and push it all the way?

I would definitely call redline with a charge like that. Unless you are ok with having a 49km/hr over on your record and the effects afterwards from that.

It's definitely not ideal, but I feel like it may be my only chance. If I plea not guilty and go with Redline, it's still a 50/50 chance that the charge will be dismissed. Would I not lose the deal the offered me initially?

I am sure Redline can get a better deal than that, How much of a better deal, I would assume alot better but that is where it comes down to what you want to do.
 
I agree that you want an experienced traffic lawyer or paralegal. Only one of those two charges will stand at trial, as you cannot be found guilty of both. Of the two the stunt driving is the more serious, but both have a very serious impact upon your license and insurance.

go to the first aperance and talk to the jp, ask for a 49 over, save the money from the lawyer.

ticket comes to $600 and inpound will be about $1000

if they dont agree on the 49 over then you ask for more time as you need to secure legel help.

if this is your first apearence they most likely wont except a plee at this time, you just plead not guilty and they will set a trial date for a few months down the road. at that time they will take the plea
 
OP even you ask for 49 over, you can still say bye bye to you insurance on the bike.

Check with your insurance company first, major offences for most seem to be 45+, some are 40+, apparently some are 30+ now and based on your experience SF is 50+. You want to make sure the ticket is reduced below the threshold for your insurance company.

Please stop giving advice.

You need to schedule a First Appearance with the CROWN to attempt to secure a plea bargain. It's best if you hire a paralegal. This isn't a charge you should attempt to fight on your own. The money is well worth it to pay someone to help.

If you show up on your court date and ask for more time to hire legal help you WILL be refused.

Care to explain? Preferably with proper grammar this time. You were also wrong for the ticket amount...total payable for 49 over is $359

opp got me for 172a and reduce to 49 over in court. ticked cost $600 and 4 points, thats what I paid 2 years ago. (maybe increased fine because of drop? I dont know why but thats what I had to pay.)

He doesnt need to schedule a first appearance, he has a summons (that is his first appearance).
In most cases the jp has not been over the disclosure at this time because the first appearance is only to get a guilty or not plea and to set a date for trial.
with out knowing what went on they would be making a blind guess at what you should be charged. (went through this with Caledon opp for a 49 over this spring and that is exactly why I had to wait for the trial date).

The courts are very good with people to be honest. If you dont have legel help and said you need it then they will grant you the time (an amount they see fit) to find someone (iv done this at least 4 times when needed.) If they dont then you can appeal the conviction because you had no representation.
