When my father found out I was buying a new bike (took her home yesterday!) he asked for my old one; I am giving it to him. Do I need to get a UVIP and a Safety and all that? Or can I just sign over the ownership slip and be done with it?

I just did the same thing last week and didnt need a UVIP but did need a safety to license it... your dad will have to be there both of you need to sign some papers
 
yes you still have to do all that. But you don't have to pay taxes when transferring a bike between imediate family members. Just fill out the form (sworn statement of family gift- see MTO website) and you need to have the form signed by a commisioner. Some service Ontario locations have a person on site that can give you both the oath. Remember you both have to be there. I would call first.
 
1. Get bike safety'd
2. Walk into a MTO branch
3. Walk to one of those Help counters (no line up) and tell them you need a sworn statement to avoid taxes
4. Line up and transfer the name without paying taxes.


Plate can be transferred from Father to son but i don't think its possible from Son to Father, so he'll also need to get new plates.
 
If we don't care about the tax exemption do we both still have to go and sign that special form in order to avoid the UVIP?

Avoid UVIP? UVIP is optional. Regardless of what you do, a safety is required, and you'll still have to go into the ministry.

If you dont care about the tax exemption , skip Step 3.

A UVIP is required to be provided to the buyer from the seller, it's the law: http://www.mto.gov.on.ca/english/dandv/vehicle/used.shtml "By Ontario law, private sellers of most motor vehicles, including motorcycles, must provide buyers with a Used Vehicle Information Package."

What I want to know is, since my dad and I would be exemption from the UVIP, do we have to do that form (the one that would exempt us from tax) in order to have this UVIP exemption or can we just go ahead and do it without filling out the form (because we don't care about the tax now).?

A UVIP is optional, i have never ever bought a UVIP to transfer a family vehicle into my name and vice versa, nor have they asked. The only thing required was a Safety + Sworn statement.

A safety is required anytime the ownership is changed, even if it was just done and "used".

Like i said above, follow my steps and you'll be done in a jiffy, stop making things complicated.

If you want confirmation, just call the MTO and ask what is required if you want to transfer your bike to your dad.

A sworn statement is to prove that you guys are indeed father and son. Its not required but then you'll have to pay taxes on top.

Otherwise, just write up your own bill of sale

e.g. BOB sold me ADAMS Bike X for $XXXX.

and sign. But you will need to pay $20 which is essentially buying the UVIP on the spot.
 
Sushii, I think you are confused. You keep not answering my actual question; rather you answer some related question that I didn't actually ask. I appreciate your attempt to help but your answers don't make sense in light of my questions. You are making things quite complicated.
 
How it went for me when I bought my (err.... was given) dads pick-up.

Since it was an older truck I was ready to pay taxes. I went in and told the girl I needed to put the truck in my name, I already had safety and emissions done. She noticed the last names were the same and asked if we were related, I told her yes, the owner was my father. She said ok, so there's no taxes then. I paid for a new sticker for my plate and I think something for the ownership and away I went.

If you trust him, you can just sign over the ownership.
They'll let him know if they have any problems with the documentation.
He will also have to deal with his tickets when he goes in.

OP - to avoid going together or getting sworn statements just tell your dad to declare a selling price of $1. He'll pay the 13 cents in taxes and be done with. No one can do anything about that. You can sell your bike for whatever you wish. More often than not, MTO doesn't ask for a bill of sale anyhow. Occasionally (very rarely), they will send letters asking to confirm the selling price, to both the original owner and the new owner. Most people throw those letters in the garbage. If you wish to be nice, you can both send them back though and as long as the number matches, no one will harass you.

... And if they do bother him, even though they really shouldn't and are not allowed to, he can say that he got his bike from his son and the one dollar is symbolic since the bike was free.

Just remember if he doesn't have safety with him, he will have to make one more trip to the MTO eventually. So if the bike is still licensed and plated it may be a good idea to safety it first so your dad doesn't have to bother with a 10 day temp or towing the motorcycle.
 
Wow, this got confusing real fast.

It's just a sale between you and your dad. That's the basics. You need a receipt of what he 'paid', you provide the uvip and a safety. (or at least he'll need to have them when he registers).

If you want to save taxes (gifted to your dad - no money changed hands), then you go to the municipal offices or to a commissioner in general, (both of you as noted above), repeat whatever they say, sign a form and done (15 mins tops).

if you dont' care, it's just a regular sale and subject to whatever the minstry person at the desk accepts as your purchase/selling price.

A UVIP is not required when changing ownership between family members, i have done this twice and was never asked/charged for it.

Safety is not required to change ownership but i assumed his dad was going to ride it
