Getting out of a Cell Phone Contract

First off, no "Rogers sucks" or "blackberry's suck" responses needed, that won't help so keep that to yourself.

Not surprising to any I'm sure but Rogers has ****** me off to the n-th degree. Long story short I call tech support for a phone swap under warranty and they refuse to replace the unit calling my issue 'physical abuse'.

How they are able diagnose this over the phone is nothing short of fecking spectacular cuz I know I wasn't talking to the Amazing Kreskin. I had to call Blackberry Tech support - they were surprisingly amazing - to call Rogers to let them know that my issue was valid and certainly not physical abuse.

I am holding up my part of the contract but they are not holding up their end. I consider it a breach of contract and I feel I have a valid reason to get out.

Anyone have success getting out of their contract?
 
Take your phone to a physical rogers store, you are stuck with your contract (unless you pay the $200 fee to get out of it) but you might get a new phone under warranty from the store.
 
I did take it into a store but they were out of loaner phones so I called and that's when the mayhem started.

They replaced the unit after a RIM rep was involved. So from that standpoint I am already taken care of. It really is the principal of the matter.
 
Sorry dude but a contract is a contract. Suicide can get you out, which makes me wonder did anyone try to forge a death certificate?

It's only a contract when both parties are upholding the agreement.

Unfortunately these companies are faceless corporations and you'd have a helluva time getting out of your contract on those grounds without spending some money. At least I think so, anyway...
 
Have someone else takeover your contract. Post the plan plus pertinent details and your phone on craigslist or kijiji, throw in some money to entice.
 
Thank you for all the advice so far. I learned through a good friend that the CRTC has a section dedicated to complaints and questions. They promise to respond within 10 business days. I put the question to them and I will let you know what the outcome is.
 
death doesn't always get you out of a contract, it just some times makes it unfeasible to collect.


I watched my aunt take care of my grandmas estate after she passed.... it takes up to two years to send out copies of the death certificate and get everything cancelled. And then pay the remaining balance.

Just curious how they're not holding up their end of the contract...? Did they refuse you service? You know they are a service provider not a cellphone manufacturer or warranter? Whether or not your BLACKBERRY works has nothing to do with Rogers end of the contract. Just FYI.
 
It was my understanding that all you have to do is pay the outstanding credit balance on your phone? My telus phone has a payout balance of $150.00 (6 mos remaining x $25 per month). If believe if I pay that outstanding amount I can cancel my contract.
