A friend of mine received a speeding ticket in Mississauga. I have also asked her to get the disclosure from the court so she can defend her case. One other thing I asked her to check was whether the officer tested his radar equipment before and after his shift that day. She mentioned she was going to see the prosecutor for a first attendance meeting. She was going to bring that question up with the prosecutor. I stated that she should pass on first attendance and just go to trial and try to talk to the officer before court to see if he tested his equipment. If he states no, go to trial and the charge will likley be thrown out. I suspect this is the better route than to raise the question with the prosecutor now who could potentially use the time between now and court to coach the officer. Your thoughts?
