Driver's abstract error corrections?

Quick question here. I had a ticket last year for running a stop sign. Sort of a ******** trap (New stop sign hidden in construction zone behind a loader, deliberate cop-trap set up), but whatever, I didn't contest it. It's one minor and my record is otherwise clean so it had no effect on insurance or any quotes.

Thing was, it was a bicycle offence. When I was worried about my rates at first, I found out that under section 210 of the Highway Traffic Act, I should not receive any demerit points (I know demerits only matter for licensing and not insurance) and also that the conviction should not show up on my driving abstract. That was a big part of the reason I chose not to contest it - better to just pay $105 and be done with it if there's no other effect.

This year, when I called around, I noticed that not only is the ticket showing up on my abstract, but it is also not listed as a non-motor vehicle offence. Who do I have to whine at to have this fixed? I still have my conviction record papers, though I don't have a copy of the original ticket (the ticket itself clearly states it was a bicycle offence, the conviction record simply shows a blank where a plate number would be listed).

Do I just get screwed on this or is there any recourse?

Again, it's not affecting my rates, so it hasn't cost me anything yet, but I'd rather not have that on there, just in case. Any ideas? Googling didn't really turn up much. Thanks!

Hopefully someone can chime in and point you in the right direction.

My first thought would be to call your local service canada and ask them. They should be able to guide you in the right direction

If the information on your driver/vehicle record is incorrect, please call ServiceOntario at 416-235-2999 (GTA) or toll-free in Canada at 1-800-387-3445 to have an agent look up your information and give you details on what can be done to correct the information.
Based on the information that needs to be changed, you may be required to send additional documents for verification purposes.

Where did you read that the conviction would not show up on your driving abstract??

You need to call the MTO "Driver Control", which is "responsible for driver record maintenance including licence suspensions, reinstatements, cancellations, re-tests and convictions". Driver record is the abstract.

MTO's Driver Control also administer the demerit point system and keep track of all convictions.

But I tell you what I think - looks like the officer got your drivers' license at the time of the ticket, so FOR SURE the ticket is going to appear on your abstract. Good luck trying to get it removed, I think they will refuse to help you. :(
 
What the ****? Serious? =/ Next thing you know they'll be giving tickets to cyclist going too fast.
 
Why would the conviction not show up? And not contesting it = guilty aka "yes, I admit I did that and will take the punishment you dish out"

OP said it was on his bicycle - non-motor vehicle.

I think this would be similar to getting a ticket for j-walking and having your insurance premiums for your car/motorcycle increase because of it.

Correct. As per section 210 of the Highway Traffic Act, only offences for MOTOR vehicles are to be kept on file by the MTO Registrar (i.e. what shows up on your driver's abstract). My thinking at the time was that it'd cost more to hire a paralegal to fight the ticket than the $105 for the ticket itself. That was the correct decision, as it turned out, only the cop missed a checkbox so the courts service folks sent it to the Ministry as a motor vehicle offence (despite "Bicycle offence" being clearly written on the ticket).

Luckily, I was able to go down to the Edwards Street court today and they gave me no trouble at all about it and agreed right away that it should not be on my record. The only downside is that now that they've notified the MTO about the mistake, it takes the MTO 5-10 business days to correct it. Argh. I wanted to switch my insurance right away... so much for that. Guess I'll be going closer to the wire (April 27th) than I'd like to.

An officer can get your drivers' license number from your health card.

Yeah, there's actually a checkbox for them to tick off if no motor vehicles are involved.

Which this dork didn't do, even though that's less effort than writing "BICYCLE OFFENCE" in big letters.
