I have two questions that I really should already know the answer to, but I dont.

1) Is it legal for me to ride in the curb lane when there are cars parked in it. Ie, where a car would not be able to fit, and where traffic tends to congregate in the left lane. Am I risking any sort of infration by doing this, aside from potentially getting hit by a car door?

2) I am in the curb lane and there is truck or something blocking the lane up ahead, causing traffic to merge left. Can I legally pass a car on the right who is midway into a merge? (I can then advcance ahead and pass the truck, whereas a car cant fit).

I have been doing both of these things recently, and figure I should get clarification. Thanks.

the curb lane has been disscussed numerous times in the Laws/Regulations/HTA sub forum. Please take a look there.
 
I seached for "curb lane". Nothing came up dealing specifically with what I asked. I dont doubt its been covered, but I dont intend to read every thread in a general search query hoping for a hit in some post. Care to suggest some better search critera, or perhaps provide a link?
 
Try searching for "parked cars" instead.

Short strokes are that it's legal to ride in the curb lane with parked cars if it's an extra wide lane, that permits you to pass the vehicles easily and in safety. Passing a vehicle that is merging to the left, on its right, is not legal. See the "R. v. Bunda" sticky post.
