I was talking to my daughter. She picked up a speeding ticket 3 years ago and has heard nothing. I know Covid backed up the courts and delays such of this have become normal, with many cases being dismissed. Are the courts still jammed today, such that I could expect to submit an 11(B) defense if I get a trial notice outside of an18 month delay, if it's not dismissed?

11B after three years should be an easy win. I assume she asked for a trial at the time? Make sure you follow the process to cement your 11B (assuming they ever reach out).
 
Did she plead not guilty?

If not, a conviction is entered in absentia after about 45 days.

She should check to see if she was convicted.

I was thinking the same thing but after three years, it will drop off anyway so no need to waste the money pulling the abstract.

A conviction drops off 3 years after the fine and penalty fees are paid.
 
Thanks for the responses. My question was actually more personal to me as I got a ticket on Saturday. I was trying to find out if the courts are still jammed as I might roll the dice, plead not guilty and hope that the ticket will get dismissed should the courts delay a trial beyond a reasonable time period.

I'd have my doubts about you waiting that long but it's always possible. Douggie has severely defunded the courts.

No chance. The pandemic changed the rules .. no more getting off if the cop doesn’t show. You’ll be in court within 6 mos for a traffic offence.
 
My twin brother (that I do not have ;) ) got an HTA infraction on May 14 2023 (Mothers day). Filed with the courts within 2 weeks of receiving ticket.
Notice of trial came in the mail at he beginning of March 2024, with a court date set for My 16 2024.
Asked to move the court date (simple form that can be emailed) to a later time as said family member will be out of the country on that day.

This is the experience with the Halton Court.

BTW, you can be out of town on the court date but you can still attend virtually.

If it wasn't paid and wasn't filed to fight is it good chance she doesn't have a license anymore I would check.

The downside to kicking the can down the road is you kick the date that causes your ticket to drop off your record.

I doubt your predicament is the same as my buddy's -- he kicked a DUI down the road for 2 years, ended up costing him 2 extra years for facility rate insurance -- about $10K. He got nothing out of it other than delaying his 6 mo suspension.

How did I cost him two extra years of insurance? Did he get forced to facility when charged? That's bullocks as he hadn't been convicted.

Not the same predicament.

Mine is a octagonal sign issue.

My can is only being pushed 2 months down the road so not a huge issue in terms of timing should it not go in my favour.

But yes I have been there and that that before.
Years ago I received a ticket in the Kawarthas and filed to fight it.
I ended up just paying for it as I didn't want to go to Lindsay for the court not hire a lawyer. I "lost" a year of time.

Where did you get that from? That doesn't sound correct.. no cop, no evidence. They can request an adjournment.. but the defence can and should argue it.
