Course of action - seller ripped me off

you could come by Peterborough cycle Salvage tomorrow (call first to see if we might have something) with your old carb and we can see if it matches up with anything. We're open only form 8:30 -noon, and then we're closed all next week for holidays.

He does have a legal right to take him to court.
And there is an expectation that the thing you buy from a private sale is expected to perform in a normal way, unless otherwise stated in the bill of sale.

Wrong, private sales are simply buyer beware. Even if he didn't say there were no warranties it still doesn't amount to ****. The only recourse would be if a mechanical issue was related to a shop and a safety or if the vehicle wad stolen.

When you buy private you are buying from an individual not a business. Warranties do not exist.

You will spend far more than this on future maintenance or even just as much changing fluids etc.

A: James Hamilton, manager of mediation services for the Used Car Dealers Association of Ontario ( www.ucda.org), replies:

While there is no standard or mandatory warranty in Ontario for used vehicles, such sales are covered by the implied warranty of fitness in the Sale of Goods Act, which provides that goods will be fit for the use intended by the buyer for a reasonable time after the sale.

The UCDA recommends that its members consider including a dealer guarantee when selling a vehicle that states exactly what is covered and for how long. Many dealers also offer third-party extended warranties, covering specified repairs for various time periods.

Okay ive had problems with the whole diaphragm assembly on one of my zx7s before. The rubber part can be fixed if its just a minor tear. However since you're just looking for the slide itself im guessing the rubber is fine. I managed to source mine out from this really small shop out in orangeville. Place is called proformance cycle. From google the number is the same 519-942-2082 .Give them a shout. They MIGHT just have it. I paid $25 for the whole assembly btw BUT im not telling you that you're gonna get it for that price. I dont know the guys personally but i was desperate for my part so i called them up. Worth a try.Cheers.

So you found the part... good.

Why not just contact the seller, preferably by e-mail if you have the address, and politely ask him to compensate you for the broken carb part that he McGivered (sp??) to make the sale. He'll know what you are talking about and what's the worse he can do now other than just say no.
