Bought a car with a lien

I bought a car yesterday that needed repairs...so i decided to buy it off the guy and fix it up. When i bought it off him, he did not mention nothing about a lien, handed me over the ownership papers and he did not sign the signature of buyer on the back. Today i went to the ministry and i decided to see if there is any dirty history to it....then i found out it has one lien on it. I tried contacting the guy but he doesnt pick up. Im pretty upset, frustrated and angry with this situation. Now i dont know what to do...is there anyone who can help me out and let me know whats the next step?
 
What year, make and model is the car?...
It could of been an old lien that was never released.
 
didn't he have a UVIP with the car?
 
best bet is contact lien holder and ask them....
They should be able to clarify the problem, but prepared to get the run around...
If the vehicle is not in your name, they may be hesitant to release any information.

Don't you have his address on the ownership?
Go and see the guy and sort it out in a decent way if at all possible.
 
That's why you always get the UVIP. What's the car? How much are you out? How much is the lien? Who holds the lien? If the seller doesn't cooperate it will cost you time and money to pursue the issue. Depending on what your time is worth you may have to suck it up. It isn't a police matter as they will consider it a civil issue so you are stuck with small claims court.

How do you plan on getting the transfer without the signature on the ownership?

You skipped a bunch of procedures and now have possession of a vehicle you don't legally own. The vehicle needs work, has a lien against it and someone has your money. If you have a receipt from the owner (Assuming the person you were dealing with was the owner) you should check out small claims court.

I don't know if it would work but if you decide to walk away you could tow the vehicle out to the street nad have it impounded. The fees will go against the owner, assuming you didn't somehow transfer it.

Yeah the lien is under his name and i just came back from the bank where he got the loan. They would not give me any information because of the privacy...

i did leave a msg in his voice box telling him he forgot to sign it. So im hoping he calls me back and comes to sign it and tell him about his loan he owes.
 
For God's sake, the MTO is not going to investigate the signature, just sign the damn thing and transfer it...
Do you have any paperwork saying the the seller has indeed sold you the car?

Yeah i know that people forge the signature...but i want him to personally come to see that he has a lien and he had not told me about it. Thats i why i left a msg telling him to come down to my place and sign it. I dont have any paper work saying he sold it to me.
 
Jesus man, is this your first time buying a vehicle?...
How did you pay the seller? Cash or certified funds?

No. It won't.
As long as the seller is the actual owner of the vehicle, then it's all good.
Now, if he's selling it on "behalf" of someone else, well... that's a whole different ball game.
