My birth date with the cra has been wrong for years now and have always filed with the wrong birth date because I always forget to change it at tax time and need to do my return.
Now, I got reassessed and I owe them money now. They still have my wrong birth year, but I was wondering with a good tax lawyer if I could get off based on that birth year deal.

I know its a long shot with the government, but worth a shot.

I'm NOT a tax lawyer, or even close, but this is too ****ing funny.
Would you be tracking down a tax lawyer to get out of this if the reassessment showed that they owed you money?
Do they have your Social Ins Number correct? Yes? That's what I thought.
Do they have your address correct? Yes? That's what I thought.
It's yours / mine / everyone's obligation as a Canadian to let the CRA in on EVERYTHING. They should know your DOB, but if it's wrong in the files, it's up to you to make the correction asap - same as moving / address change.
Not likely to 'wash' the taxes owed, but hey, give it a go!!!! Update us on the outcome.
 
What your trying to do, is called tax fraud, and could send you to jail if your convicted. No lawyer would do it unless your capital is worth over billions and you can pay them to take the risk

I'm no expert, but I'm sure CRA might be willing to forego the reassessment on that basis in return for failure to file, with tax, interest & penalties going back as long as your birth date has been wrong, LOL! It's your fault your birth date is wrong, not theirs, so you're still on the hook - it's no basis to challenge a reassessment.

I've retained tax lawyers for tax advice at rates any where from $450 to $850 per hour. Expect a retainer of at least $10,000.

Don't get in between the CRA and their tax dollars. I just paid $17,000 in taxes today. I feel disgusted and wanted to take a shower after the payment, but glad I did it. I don't want to be anywhere near an audit.
 
Thats about the amount im at as well. I am not going to worry about fighting mine, but I will notify them of my wrong birth date and I am sure they will at least put the stuff on hold and possibly reassess again to see if any other changes, but I dont think the birth date will change the amount i owe either way.

CRA is not TPS. You're income tax owing is not a parking ticket you can get off with a simple technicality. Pay up or they will hunt you down and look at you under a microscope with all your future tax returns.

I just palmed my face.

Even a parking ticket can't be stricken because of a DOB or spelling error. It's considered a clerical/administrative error and can be corrected by any JOP on record.

Its a forum and i asked a question... simple! Now that I know through all you very smart people on here, like i said i will just get it changed and pay it!
