49 over code R advice

younger brother got a speeding ticket last night in the cage. officer reduced it to 49 over with a code R, officer claimed original speed was 65 over. my brother was clearly guilty of the offence the way he described it to me. i know details are lacking, he's an idiot i know. is this sort of ticket worth fighting ? or should he pay the fine, take the insurance hit and thank the gods he didn't get a HTA 172 charge ?
 
Hire a professional.

If he gets him off then kick him repeatedly in the nuts so he actually learns a lesson.
 
Some insurance companies would treat this one the same as a 1km/h over (yes 1.0, one, uno). Others have a cutoff between a "minor" and a "major" at 44-45. Check anonymously with your insurer. I'd probably bend over and pay up

I got charged with Stunting, no lic, no insurance, and no plate.....They impounded my bike even thou it was on my own property...Anyways long story short most people told me Im was ****ed...I paid my paralegal $1000 at first and he said all he can do is reduce everything to 1 careless driving ticket, or another $1400 and it never happened. I gave him the $2400 total and all charges were withdrawn. So never give up without a fight, its worth spending money to keep your record clear IMO...Even the $900 impound fee, I had reduced to $230 with a phone call to a friend that works as a tow truck driver...
 
1. Request a court date
2. 8 weeks prior to court date request disclosure

Depending on the disclosure, fight or try to get it lowered (talk to prosecutor prior to trial).
If not ready to thoroughly do the research required and to argue your case, as well as taking the time off of work, I highly suggest hiring a professional.

it sounds like your paralegal had a man on the inside with major influence if he was confident enough to tell you it was going away.
 
The problem with hiring someone is that it's expensive and may not save you any money. If you have the ticket reduced you'll pay a lower fine but unless the ticket is completely thrown out the minor conviction is still a minor conviction for insurance purposes so you aren't saving any money there. Don't get fooled into the 'you gotta get the points dropped' BS. Points don't cost you any money and as long as you aren't a chronic speeder they're likely not going to catch up with you. Insurace does NOT care about points. If I were you (and most x-copper type places will tell you the same) it's not worth hiring someone to fight a minor. I wouldn't even take a day off work to fight it myself but if you have that kinda time then go that route. Keep your head down and don't give your insurance company a reason to pull a new MVR and they might not ever even find out about it. I've had tickets slide right on thru before, and I didn't shell out for a professional. I know this won't be a popular opinion but odds are in this situation fighting may end up costing you more than eating it.

I don't know how they do it, and honestly I don't really care. However that is not the first paralegal I have used over the years, that has given me the option to pay more and have it disappear completely rather then pay less and take a deal...Basically from my experience with tickets and court is money talks. And in general for me it has always been worth the cost to hire a good paralegal to fight for me...In the long run it will save me money due to the stain convictions put on your insurance costs

Go with Redline. They charge 25% more than the rest but they give you that level of service every time. With others, regular late is a plea deal which you would get without getting ripped off by one of those bums. The extra $1000 was to get him to actually do his job.

+1 to this. If money is an issue it can sometimes be in your best interest to just pay the fine (as long as ins. sees it as a minor and they don't surcharge till the 2nd minor ticket) and suck it up for 3 yrs till it drops off your abstract.

I went and had a major dropped to a minor (couldn't afford to pay someone to fight), paid the lower fine and rode like grandma till it disappeared. Hell I still ride like grandma, I hate getting tickets and having to even deal with it in the first place. I even lucked out and the ins company didn't run a abstract check so they never saw it.

Moreso, there is something fishy if a copy reduces what is a street racing charge and vehicle and license suspension, which from my understanding they are required to enforce, and they cannot reduce an over 50 ticket, but hey, its the police, they do whatever they want to - legal or not.

You're thinking of Stunt Driving. Given the details we don't know if there was street racing. Cops reduce tickets from 50+ pretty regularly, since most people thank the gods and just pay 49 over.

No cop would reduce a 65 over ticket. And if they do, there is something wrong with the evidence.

Hmmm something to consider. Both companies I've worked for consider 49 and lower a minor. I'd check that out first. If its a minor than see above. If its a major that could change things.
