We don't know how the law is interpreted. I've seen enough "Do not block intersection" and "Do not block driveway" signs to make me believe the law you cited is not so black and white when it comes to city streets.
Yeah, I would still put the provided rubber band over the grip tape so that the contact friction material is still the same. Essentially just trying to fatten the bar/grip a bit under the rubber band to slightly increase the friction to the point of not releasing due to simple vibration.
I wonder if the average citizen will now be able to cite this case and use the "momentary inattentiveness" excuse to get off a dangerous driving charge. Probably not, simply because the charge wasn't beat in court, but simply never logged, so the precedent doesn't really exist.
