The franchise agreement will restrict the dealer from selling above msrp/list on a new never registered vehicle. It can be traded in the next day and sold for whatever the market will pay as a used car though.
The person who ordered it or first buyer gets it at list. They can then turn around and sell it back to that dealer or another dealer at a profit if there is enough demand for that specific vehicle.
